ISO 37002:2021 standard provides a reference to acts or omissions that may lead to illegal, unfair or dangerous practices within a public or private entity. Studies show that a large percentage of offenses come to the attention of the public or private entity involved through reports from the entity’s staff or from individuals associated with the entity.

In Greece, Law 4990/2022 is in force on the protection of persons reporting violations of EU law, while Joint Ministerial Decree 47312 (Government Gazette 6944/Β/2023) specifies the above Law regarding the procedure for submitting, receiving and monitoring reports to public and private sector entities.

Critical areas of EU law are considered to be public procurement, financial services, products and markets, product safety and compliance, transport safety, environmental protection, radiation protection and nuclear safety, food and feed safety, animal health and welfare, public health, consumer protection, privacy and personal data protection, and the security of network and information systems.

According to the standard, the main obligations of the bodies include the following:

  • Designation of a Reporting Officer (RO) and declaration of this to the Labour Inspectorate
  • Development of a procedure and system for internal submission, receipt and monitoring of reports
  • Designation of a competent body (e.g. Commission) to investigate the report

The implementation of the system results in:

  • Encouraging and facilitating the reporting of wrongdoing
  • Supporting and protecting whistleblowers and other stakeholders
  • Ensuring the correct and timely handling of reports of wrongdoing
  • Improving organizational culture and governance
  • Reducing the risks of wrongdoing

The standard’s complaints management system is based on the principles of trust, impartiality and protection. It is adaptable and its use varies depending on the size, nature, complexity and jurisdiction of the organization’s activities. It can help the organization improve its existing reporting policy and reporting procedures or comply with applicable relevant legislation.

Target Audience

  • Public bodies (Public bodies with up to 49 employees, responsibilities of the Ministry of Public Health and Social Protection are exercised by the Integrity Advisor or as otherwise defined by the legislation)
  • Private sector bodies with fifty or more employees
  • Private sector bodies regardless of the number of employees that are active in the fields of financial services, products and markets, transport and environment, as well as bodies that operate based on a decision approving environmental conditions, or whose activities may by their nature cause a risk to the environment and public health

Guidance is provided to public and private sector bodies for the creation, implementation, maintenance and improvement of a complaint management system.
